Welcome to Mentark ("we," "our," "us," or "the Platform"). These Terms of Service ("Terms") govern your access to and use of our career analytics and diagnostic platform, including our website, mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

These Terms are governed by the laws of India and are subject to the jurisdiction of Indian courts.

By accessing, browsing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must immediately stop using our Services.

Mentark provides career analytics and diagnostic services for students, including:

• Diagnostic Assessments: Psychometric and academic diagnostic tests for JEE and NEET preparation
• Career Analytics: Analytics dashboards and insights for graduate students across various degree programs
• Career Path Simulations: AI-powered career path recommendations and simulations
• Academic Indices: Computation of academic strength, cognitive blueprint, and other analytical metrics
• Personalized Insights: AI-generated descriptions and explanations based on your profile

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of our Services.

4.1. Age Requirement

Our Services are designed for students aged 17-22 years. If you are below 18 years of age, you must obtain parental or lawful guardian consent before using our Services.

4.2. Account Registration

You may use our Services with or without creating an account. If you choose to create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4.3. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

You are responsible for:

• Providing accurate and truthful information in diagnostic assessments and profile creation
• Maintaining the confidentiality of your account credentials
• Using our Services in compliance with all applicable laws and regulations
• Not sharing your account with others or allowing unauthorized access
• Respecting the intellectual property rights of Mentark and third parties
• Not using our Services for any illegal or unauthorized purpose

You agree not to:

• Use our Services to violate any applicable law or regulation
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the operation of our Services or servers
• Attempt to gain unauthorized access to our Services, accounts, or systems
• Use automated systems (bots, scrapers) to access our Services without permission
• Reverse engineer, decompile, or disassemble any part of our Services
• Remove or alter any copyright, trademark, or other proprietary notices
• Use our Services to transmit any malicious code, viruses, or harmful data
• Collect or harvest information about other users without their consent
• Use our Services for commercial purposes without our written permission

Violation of these prohibitions may result in immediate termination of your account and legal action.

7.1. Our Intellectual Property

All content, features, functionality, and intellectual property on our Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, algorithms, and compilations, are owned by Mentark or our licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws.

7.2. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use, subject to these Terms.

7.3. Your Content

You retain ownership of any content you submit to our Services (such as responses to diagnostic questions). By submitting content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, and distribute your content for the purpose of providing and improving our Services.

Some features of our Services may require payment. When you make a payment:

• Payments are processed securely through Razorpay, a payment gateway authorized by the Reserve Bank of India
• All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes
• You agree to provide accurate payment information
• You authorize us to charge your payment method for the amount specified
• Refunds are subject to our Refund Policy (see Refund Policy)

We reserve the right to change our pricing at any time. Price changes will not affect purchases already completed.

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

• Our Services will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• Our Services are free of viruses or other harmful components
• The results obtained from using our Services will be accurate or reliable

Our analytics, insights, and recommendations are informational and advisory in nature. They are not guarantees of future outcomes, career success, or exam performance. You should use our Services as one of many tools in your decision-making process, not as the sole basis for important life decisions.

To the maximum extent permitted by applicable law, Mentark, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use our Services
• Damages arising from decisions made based on our analytics or recommendations
• Damages arising from unauthorized access to or alteration of your data

Our total liability to you for any claims arising from or related to our Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or ₹1,000 (One Thousand Rupees), whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11.1. Termination by You

You may stop using our Services at any time. You may also request deletion of your account and data by contacting us at connect@mentark.com.

11.2. Termination by Us

We may suspend or terminate your access to our Services immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• We are required to do so by law
• We discontinue or modify our Services

11.3. Effect of Termination

Upon termination, your right to use our Services will immediately cease. We may delete your account and data in accordance with our Privacy Policy and data retention policies.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending an email notification to registered users
• Displaying a prominent notice on our platform

Your continued use of our Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using our Services.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
